HILLSBORO — Three students at Liberty High School have been charged in an October gang shooting.

Miguel Reyes Gonzales and Ezequiel Santos Gomez, both 16, and Carlos Peguero Villa, 17, have been charged with attempted murder and unlawful use of a weapon against another.

The three teens were arraigned last week in connection with the Oct. 11 shooting and are being held in the Washington County Jail on $250,000 bail each. Their preliminary hearings are set for Wednesday in Washington County Circuit Court, at which time the charges may be amended.

All three told police they were members of the 13th Street gang, said Lt. Michael Rouches, spokesman for the Hillsboro Police Department. They were arrested after Gonzales allegedly shot Fermin Mandujano-Marin, 22, of Hillsboro.

Rouches said Gonzales had been shopping in the 1000 block of Southeast Walnut Street and was on the sidewalk a couple blocks away, making gang signs with his hands, when Mandujano-Marin drove by.

Rouches said Mandujano-Marin was a member of the rival 18th Street Tiny Winos Sureno gang. He walked up to Gonzales and asked why he was making the gang signs, Rouches said.

Gonzales allegedly responded by shooting Mandujano-Marin in the thigh with a .32 caliber semi-automatic pistol. Rouches said the slug didn’t cause serious damage because it didn’t strike bone or sever a vein or artery. Gomez and Villa are thought to have served as “lookouts,” Rouches said.

“They were looking for an 18th Street gang member to shoot or fight with,” Rouches said. “They were looking for trouble and they found it.”

Its nice to see hardworking illegal aliens mexicans are making friends with drug dealers and dealing drugs. I am sure Obama , and Wyden and Wu and Merkley will be glad to give them a pathway to citizenship. Mexican Illegals have no problem engaging in criminal behavior yet the Oregonian etc covers it all up.

On February 4, 2009 at 7:30 a.m. the listed agencies participated in the simultaneous execution of search warrants. Information developed subsequent to these investigations led to an arrest and seizure of methamphetamine and marijuana in the Portland area.A search warrant was served at 916 NW High Street in Newport where officers contacted a 31-year old Hispanic male mexican Mostly likely illegal male who was not taken into custody but information will be referred to the Lincoln County District Attorney’s Office for consideration of charges. ( snip).

As a result of the earlier search warrants LINT members and Lincoln County Sheriff’s Office conducted a traffic stop Wednesday night at 9:30 p.m. on Yasek Loop near milepost 2 involving a 1997 Nissan Pathfinder. A search of the vehicle resulted in the seizure of an ounce of methamphetamine and 1,300.00 cash. ARMANDO YANEZ HERNANDEZ age 22, and JOSE LUIS HERRERA MATA, age 19, was arrested for Unlawful Delivery and Possession of a Controlled Substance – Methamphetamine.

Also later in the day LINT members traveled to the Portland Metro area where they continued their investigation from the earlier search warrants. LINT detectives met with the HIDT Drug Task Force team who assisted in the investigation.

At 10:12 p.m a traffic stop was initiated on a 2001 Ford Windstar Van near SE 102nd Avenue and SE Foster Road in Portland. A search of the vehicle yielded 2 ounces of methamphetamine and the arrest of RUBEN OSWALDO IBARRA-BUENO, age 40. A subsequent search of IBARRA-BUENO’s residence led to the seizure of over a pound of marijuana and a firearm. He was lodged in the Multnomah County Detention Facility for Unlawful Delivery and Possession of a Controlled Substance – Methamphetamine and Marijuana.

The HIDTA Drug Task Force DRUG TASK FORCE (HIDT) is made up of members of the Portland Police Bureau, Oregon State Police, and the Immigration and Customs Enforcement.

LINT is comprised of members of the Oregon State Police, Lincoln County Sheriff, Lincoln City Police Department, and the Newport Police Department along with the Lincoln County District Attorney.

R-O-P-E Shows How to Strangle Grassroots Influence — Warmup for Amnesty Passage?

We now have seen the ROPE swing into action and show its style. The implications for immigration policy are, frankly, terrifying.

R-O-P-E is the Reid-Obama-Pelosi-Emanuel power bloc that called the shots on much of the Stimulus Bill with very little say from anybody else in the end. ROPE decided that illegal aliens would be welcomed to Stimulus jobs and made sure that the 533 Members of Congress never got a chance to truly weigh in — or be held accountable.

Majority Power in the 1980s

I remember being a congressional correspondent during the 1980s after Democrats had controlled the U.S. House of Representatives for three decades. The abuse of power was pretty incredible. The Republican Members were allowed only tiny amounts of influence as the Democratic leadership allowed it.

Majority Power in the 1990s

Republicans took control of the House in the 1994 elections, partly by promising the American people that they would allow everybody’s Representative to have some influence. The Republicans promised to run the House in a manner fair to everybody.

But within a few years, Republicans began imitating the abuse they had campaigned against. There are differences of opinion on the matter, but I believe that near the end of their reign in the House, the Republicans were more abusive of their power than the Democrats had been.

Now the Democrats have taken back control, partly by promising the American people that they would end the abuses of the Republicans and restore fairness to the proceedings of the House so that every Congressional District’s representative would have a chance to have influence.

HOW R-O-P-E MAY STRANGLE US

If the last two weeks are any indication, I think we will have to say that the ROPE team is the most dictatorial of all.

If the ROPE team is going to try to rule with a disciplined near-unanimity of its own Party, the American people are going to have almost no chance to improve our immigration policies and a very scary chance of a giant amnesty passing later this year.

Here is what the ROPE showed us in stripping the Stimulus Bill of E-Verify positions:

When the idea first came up of using E-Verify to keep illegal aliens out of the Stimulus jobs, ROPE realized that to oppose it in the House Appropriations Committee would look bad in public. So, ROPE allowed the restriction to go into the House bill on a voice vote, promising their open-borders friends that they would get it out in the Conference negotiating committee.
If the Senate had passed the same E-Verify provision, it might have been very difficult for the Conference committee to get rid of it. I don’t think there was any way that 41% of Senators would have openly voted to allow illegal aliens to get Stimulus jobs. So, ROPE refused to allow Senators to vote on the E-Verify amendment.
Despite talk of making the Conference negotiations transparent and open to the public, ROPE knew that if citizens saw the 10 Conference negotiators turning down E-Verify there would be a backlash. So, ROPE decided the shape of the final Stimulus Bill behind closed doors, just among themselves and presented the whole thing as a take-or-leave-it proposition to the Conference committee. Since ROPE had removed E-Verify in secret, the public had no chance to see what each of the negotiators might have done if they had made the decision themselves.
In the end, the Stimulus Bill was passed so that illegal aliens have the same access to Stimulus jobs as they do to all other jobs now — which is pretty open access. But except for the four members of the ROPE team, no other Member of Congress can easily be held accountable for passing such a huge pro-illegal-immigration bill.

As you can see, this process is meant to minimize the ability of individual citizens to hold anybody accountable and to exercise any influence.

WHAT CONSTITUTES FAIRNESS?

Perhaps the two most important things that a majority Party can provide to ensure that individual Americans have a chance for a voice in the proceedings of Congress are these:

the ability of all Members to offer amendments
public recording of roll call votes

It was the lack of these two opportunities time after time under the previous Republican regime that enraged Democrats who eventually were able to convince the public of the wrongness of that kind of power stranglehold. Every American’s representative in Congress ought to have the chance to offer amendments. Even if those amendments are killed in a public vote, citizens backing the amendments can feel their voice was at least heard and they can know which Members agree or disagree.

Especially in the handling of E-Verify the last two weeks, the ROPE regime has shown an ugly hand in denying immigration amendments or public votes.

All of us will have to do all we can to expose this hand for its anti-democratic meaning and cause ROPE to believe that continuing the stranglehold may be counter-productive. Otherwise, we can expect the passage of amnesty for 12-20 million illegal aliens this fall.

Virtually all of the Mexicans arrested in Oregon , whether for rape , or murder or drunk driving ,have landlords who rent to them knowing full well they are high-risk and illegal. Oregon Landlords misuse the Fair Housing Act to keep in the $$$$ black. If they had to depend upon just legal Americans for rent monies, they would have to lower rents and become decent landlords.Instead, they fill up on Illegals, even Washington County fills up the low-income housing with illegal alien drug dealers, ignoring that it is supposed to be for poor Americans. It would be nice if people would connect the dots between rental vacancies and a 17 percent inflow into Oregon, partly from Illegal aliens. All I know is that Oregon had cheap rent until the exodus from California began in the early 90’s ,which was also when the mexicans began arriving.

Property managers are useless in keeping out criminals, because if they don’t keep the places rented, they can be evicted in 72 hours and many landlords use this as their weapon.

Dana Countryman was murdered by two mexican gardeners, illegals, who happened to do landscaping in the same complex where Dana had her neck stomped on . If her family had any money they could have filed a civil lawsuit against the landlords.

Landlords are some of the worst crooks in this state and running little workshops is feeble. A few blocks from where this will take place are several huge complexes taken over by illegal aliens. In less than one week, Oregon State Police (OSP) troopers have made a significant seizure of suspected cocaine during a traffic stop. The latest traffic stop Thursday afternoon on Interstate 5 north of Woodburn led to the arrest of three men Illegal aliens from Mexico and the seizure of approximately 51 lbs. of suspected cocaine.On February 26, 2009 at approximately 4:00 p.m. an OSP trooper stopped a rented silver Mazda passenger car northbound on Interstate 5 near milepost 275 for failing to maintain a lane of travel and suspicion of DUII. * March 4, 2008 – 20 kilos (approximately 44 lbs.) on Interstate 5 near milepost 268 with an estimated value of $600,000.
* October 19, 2007 – 21 kilos (approximately 45 lbs.) and two pounds of crystal methamphetamine with an estimated total value of $600,000.
* July 10, 2008 – 5 lbs. of cocaine on Interstate 5 near milepost 10 with an estimated value of $65,000.

The Oregon legislature is controlled by democrats who say no bills that enforce immigration laws, will even be heard in Salem. In the meantime, most of those arrested in Oregon are mexicans, mostly illegal.The Oregonian suppresses this information.

Enforcement and a severe reduction of current immigration levels should be its pillars, said Jim Ludwick, president of Oregonians for Immigration Reform. In the meantime, the state should help fix the system.
A handful of Republican lawmakers in Salem have introduced a dozen immigration-related bills, ranging from requiring proof of legal presence to be hired by the state to requiring employers to verify employees’ legal status through the federal E-Verify database.
“Yes, the immigration system needs to be fixed, but I don’t see that happening anytime soon,” said Rep. Kim Thatcher, R-Keizer. “And I don’t picture some of these issues being addressed by Congress.”
But the political reality in Salem doesn’t favor Thatcher’s bills. At a recent meeting at the Capitol, Debbie Koreski, legislative director for House Speaker Dave Hunt, D-Gladstone, told reform proponents that most of the bills would not even get a hearing. Republicans don’t have the votes because of the Democratic supermajority in both house. And legislators are still raw, Koreski said, from last year’s discussion about stricter driver’s license requirements — blocking undocumented immigrants from getting a license — and are not eager to take up the debate.

No wonder illegal’s are not a big deal in D.C. – apparently folks have already forgotten the illegal aunt of The Anointed One. Time to take a stand against the businesses that hire them – going after invidual illegal’s will not make a difference. My guess is that it will never happen as was so astutely pointed out.

The drive to grant citizenship is ludicrous. These workers could come out of the shadows if they had a temporary worker permit. This would also eliminate the need for dangerous desert crossings on foot with “coyotes”.
There is another issue. When an illegal worker is granted citizenship, does he/she continue doing that hard manual labor? Or move downtown? Someone must have the data on this. It may be that citizenship puts an end to doing the work “that Americans don’t want to do”. Also, businesses like illegals because they work for nothing and have no rights or protections. Will they like them as much when citizenship is granted?
The mantra about “work that Americans don’t want to do” seems to come only from business owners. We have seen repeatedly over the last several years that Americans jump at the chance to take these jobs when illegals are arrested. In Oregon, many of the jobs in construction were held by Americans before they were displaced by illegals. This has a ripple effect. As soon as illegals enter a certain trade, the contractors who don’t hire illegals are forced out, because they can’t compete on price. It is the same as outsourcing, except that you outsource “in place”.
Remember that the 150,000 is just the tip of the iceberg. As soon as citizenship is granted, the relatives get an invite. Remember that the Hispanic birth rate is much higher than Americans are accustomed to. Remember that northern Mexico is in a state of criminal anarchy, which is now spreading into Arizona, and that Mexican drugs are pouring into Oregon, and that illegals are disproportionately represented in Oregon’s courts, prisons, and emergency wards. What is the TRUE COST of this “cheap” labor?
The census bureau says that the US population will increase by 130 million in the next 50 years. That is equivalent to 37 more cities with the population of the present Los Angeles. I wonder where we are going to get the energy, water, land, and other resources to keep growing our population like a third world country. I wonder what the US quality of life will be with a half billion people. Think, people, think. We can’t help everyone who needs help. Our resources are finite. Mexico needs to learn how to care for its people.

Pravda: The Coalition for a Working Oregon says employers can’t afford to lose the workers — there aren’t enough native Oregonians to do the jobs — and they need a better mechanism to get a legal work force.
BS. The unemployment rate in Oregon is 10% and on it’s way to 15%. There are plenty of workers here to do the job, especially once unemployment and welfare benefits start to dry up. Or, you could always consider WORKFARE. Yeah, y’all don’t know what that is, do ya?

I don’t know if Jeff Stone has been smoking something or had his head in the sand, but his comment “Americans don’t choose to do those kinds of jobs anymore,” is totally untrue. The facts are that his illegal alien friends come here to initially plant trees and then they go on to take carpenter and tile laying jobs by undercutting the wages of the US citizen. Furthermore, the hiring manager for the tree-planting crew is generally Mexican and is watching out for his Mexican buddies by telling caucasians that there are no openings. That is there way of job protection and it appears to work.Let’s not let the Jeff Stones of the world fool you. We need all employers to use E-Verify and be heavily fined and/or jailed if found to have hired any illegal aliens.

We need reform alright. We need to get a government with a backbone that will set up a fence with armed militia at the border, and start treating this situation as an invasion. That’s what we need-less talk, more action.

Americans welcome all LEGAL entries to our country. We have laws in place to protect us from infiltration of hostile forces. If we lift or ignore our own laws we become vulnerable to another group of pilot trainees that want to fly into buildings. By the way…what happened to the group of middle eastern men who came here for some seminar and vanished into the night? I heard this about 4 months ago and the 13 or men haven’t been located and the story faded away with them…anyone?

Simple solution: 1. secure the borders 2. cut off all benefits and services to illegals and their children 3. arrest and imprison all employers who are caught hiring an illegal alien 4. arrest and imprison any public official who refuses to enforce the above. 5. Under the threat of military force, sieze enough oil from Mexico to reimburse the taxpayers for the billions of dollars of expense this illegal invasion has cost the US.

Here is a simple start to fix this illegal problem.First, all of you need to stop paying CONTRACTORS CASH TO WORK ON YOUR HOMES! Wow, that would mean you would have to pay the true costs for the project. Most of you don’t want to do that do you. But until you do do that, don’t waste time complaining about illegals. You are their benefactors! And, stop paying contractors checks made out to them personally. Why, you ask? Because the cash them, not deposit them!!!!!!!!So what is wrong with that you ask? Well,alot! Not paying taxes is a start.First, if you pay cash or personal check, they use the funds to pay illegals cash, because they do not deposit the money!! They also don’t claim it for tax purposes, and we get to pay their share with higher rates for us. You and me.
Second, there is the great possibility the even if your contractor is licensed, you are actually responcible when his worker cuts his hand on the job. You get sued! He has no insurance for them.
Third, if you have a claim for workmanship, damage, a loss like flooding or fire, his insurance company, even if he is insured, may claim you did not contract his company, and not cover any claims you may have against him. You are screwed!
So if you feel strongly about the illegal worker issue, start today to solve it.Pay your contractors with checks only!Make those checks out to their BUSINESS name only, not to a personal name. They have to deposit all business checks, and now there is a paper trail! That means they will be held accountable for those funds. So If they continue to pay their illegal workers cash, they will at least have to claim the money and pay the taxes on those funds. That will make them have to charge closer to what legal contractors charge. You will now be protected as a homeowner.
That will allow legal contractors to employee legal workers, and send the unemployeed illegal home, or to nursery/yard jobs.This would make these under the table contractors pay what they owe to society, protect you the owner from injury claims, and reduce the number of jobs for illegals.
Additionally, make sure they are currently licensed,bonded and insured. Require a certificate of insurance from your contractor, AND all his subcontractors prior to starting any work. Yep, their illegal workers are also you liability!
So, stop paying these people with cash/personal checks today, and you will be starting to solve part of this problem immediately. If you feel good thinking you are saving yourself money, keep fooling yourself. You are paying more every day to support schools, medical, welfare, etc, by hiring them. You are taking the risks too.You are the lemons in the lemonade. If you want to pay cash, please quite crying about illegal workers! You are their boss!

If we the people would just follow the rules laid down in our Constitution and devote time to enforcing them, we wouldn’t be having an illegal alien deluge.
Who says a U.S.A. Citizen doesn’t “want to” do the jobs? We want to do the jobs at a fair market price, not below a decent living wage.
Stop supporting terrorist countries with financial assistance that don’t support our American values in their countries. I couldn’t get a loan for my business if I can’t show the government how I legitimately spend the money and enhance the community? If I can’t do this, why can hostile countries get away with any of our dollars?
Unions should be forming to bring integrity, respect and decent working conditions back to the working place. Our grandparents fought hard and heavy to bust monopolies. Our parents received the benefits of their sweat. And now, their children are getting robbed of their life savings, jobs, benefits, social security and livelihoods after spending our entire life working for the good of the country. What’s wrong with this picture?
The Constitution does not grant “automatic citizenship” to those born on U.S.A. soil. If you are an illegal alien your children are illegal aliens because you committed a felony to enter this country.
There is no protection under the Constitution for Sanctuary Cities. Stop all federal funds to cities that harbor illegal aliens under so called sanctuary guidelines.
Non-citizens should not be hired by federal, state, county and city governments that are supported with our taxes. Our government doesn’t have the money to pay us why should we be paying illegal aliens with no intention of becoming citizens? No loyalty to our country?
The solution is to follow the rules as written and protect and defend the citizens of the U.S.A.

I work in healthcare. All I see, all day, is one person after another on state assistance, for no obvious reason (disability), etc. We are giving our money away. I have nothing against these people as individuals, if someome gave me free healthcare I would take it also, and many of them are nice people. But we are supporting a lot of people in this country, actually an amazing amount.

People forget how simple a problem this is, because they don’t understand it.
Will illegals work for less wages than a citizen? Absolutely. Will illegals do work that citizens won’t do? Depends. Because illegals are willing to work for less, wages are depressed. Would more citizens do the work if wages went up? Yes, especially now. If wages are low when unemployment is low (as it has been), then no they won’t do the work, and why should they if they can get jobs that pay more? Now, when unemployment is high, if being on unemployment pays more than the wages available for doing the work, then they won’t do the work until unemployment runs out. When unemployment runs out, they will do the work. Bet on it.
If employers pay higher wages, will costs go up? Absolutely. People will also stop buying, and the markets will find a way to bring prices down. If you keep wages higher, then the costs will be driven out of other parts of the supply chain, because doing that will be less risky then breaking the law. For instance, produce grown locally will save the transportation and middle-man costs associated with long-haul delivery of food and produce. Guess what? Local farms are now back in business instead of being pushed out by agri-business. Lots of benefits.
Solve the problem. No amnesty. Require fair wages to be paid, require citizens who are willing to work for that wage to have preference over a guest worker, and put in place a guest worker program. Require guest workers to pay taxes (since they benefit from social services while they are here) and confiscate the business of any employer who knowingly hires undocumented workers or pays under the table. Let the market do the rest.
Problem is, the interests running the country have too much to gain. Amnesty creates a huge increase in votes for one side (you figure out which one). Guest worker programs without the right characteristics keeps in place depressed wages, and that benefits one side (you figure out which one). Each side has something to gain – who loses, is the country. We don’t seem to have the collective will to tell these “honorable” people to stop serving the special interests and start doing the PEOPLE’s business.

We as a nation are at war. We are in a recession, facing another depression. It is time we get our minds out of the “peace time I don’t want to get involved” mode, and choose between self and country. Go to your city council meeting and speak for 3-minutes, on what being an “American”, means to you. Read the US Constitution a couple of times, taking notes, and read the Bill of Rights, a few times. Read the first, second, ninth and tenth amemdments a few more times. Try to realize the US Constitution is the “framework” of a government, and it grants limited authority, from We the People, to those we elect. The US Constitution also limits the power of the three three branches of government, and under Section V the states. The BOR, is not a list of our rights, granted by the elected government, but it is a set of restrictions, placed on the government, to secure our unalienable human rights. We are at war, we are invaded, we have been attacked. Will you surrender peaceably, or are you going to stand up and fight for the USA? rocky4321, if an employer is paying $10, then he should be providing state approved housing, transportaion, clean water, sanitation, clothing, safety equipment, medical, dental, safety training, meals, bedding, etc. I’ve seen the migrants living in worse conditions than animals. Here we have 3 groups (unions, clergy, employers) who instead of continuing to dig in and stand their ground, are trying to come together with a compromise, to find common ground. Nothing will be accomplished by refusing to listen to each other. Apparently the groups in this article are smart enough and open enough to to realize this and not closed off by bigotry and hatred as so many posters on this thread. All of life is a compromise, folks. If you take your stand with your feet in cement and refuse to budge in your though process, you will never move forward, but become a stagnant force with nothing to add to the conversation going on around you, and thus, become irrelevant.

Nobody is talking about legal immigration. They are welcome, as far as I am concerned. But the illegal problem is too expensive for all of us. True, they work for peanuts, 6-7-8 dollars an hour. Both the husband and wife. That adds up to 12-14-16 dollars an hours. Add to that no fed, or state tax and no S.S. contributions. Now add in rent subsidy ($400 to $600 a month), free education, free medical, Welfare money and food, food stamps, and when they bring in their aged parents, who get the maximum social security payments, over 1,500 each, you can see this adds up to a pretty good living. In fact a parent brought into America will receive twice as much S.S. as I do and I contributed for over 45 years to the S.S. fund. Sure, the employers love this. Low wages and NO benefits or S.S. to pay. I will never accept illegals. The fact of the matter is, that many of us would do better if we could register as illegals! Send them home!

popppy – Your facts re social security are not accurate. If someone has never paid into the system, the receive only SSI (supplemental security income) which is closer to $600/mo. I’ll wager that most of the undocumented workers take in a whole lot less than what you have outlined. Yes, there are cheaters of the system (both citizens and non-citizens) but most folks who are not here legally are afraid to apply for the benefits because they want to remain invisible, and not be deported.

Simple solution: 1. secure the borders 2. cut off all benefits and services to illegals and their children 3. arrest and imprison all employers who are caught hiring an illegal alien 4. arrest and imprison any public official who refuses to enforce the above. 5. Under the threat of military force, sieze enough oil from Mexico to reimburse the taxpayers for the billions of dollars of expense this illegal invasion has cost the US.
If you just have #2, 3, & 4 in place, you will never need to spend all that money on #1. Illegals come here for specific reasons and if you take those reasons away, they will go home. Most of them wouldn’t have to be forced to go, either. It would be so much cheaper than militarizing our border. I would also add very stiff, punitive fines to issue people caught hiring illegals. Make it a felony so they can never own a firearm again. You’ve got to make the consequences for hiring an illegal so ruinous, no one will ever consider it. It’s also excellent PR. Cut the benefits and cite the coming Depression and revenue shortfall, aggressively prosecute the employers and not the illegals themselves. Then no one will be able to cry racism and make it stick. This will only work, of course, if you’re doing this for the general welfare of the citizens and legal residents of this country and not because you really are a racist.
There’s no chance #5 would ever happen, so just drop it now. We’d spend more money on the military operations to seize oil than we’d get in from its value. Besides, with the amount Mexico spends dealing with the crime and warfare as a result of the drug war in the United States, we’re pretty much even when it comes to costs.
It seems to me that the majority of people who vocalize and organize their opposition to illegal immigration and amnesty for existing illegal immigrants need to learn to take a deep breath, think before they speak, and approach this rationally instead of emotionally. If they did, I’d join them. As it is, I’m not going to support a bunch of fools who haven’t come to the realization that many people find bigotry abhorrent and would rather stay silent than support a bunch of racist morons.

Jexpat, the groups in the story knew in advance the outcome of their “long, complex deliberative process”. They then wove a story and a process which would safely get them to that outcome. I wasn’t there, but I would wager that the potential negatives of that outcome were never discussed. What came out of their process was pure, undiluted self-serving spin. They couldn’t care less about the impact on America. These are the same people who justify outsourcing. Their brethren in Mexico make up 2% of the population, but own 98% of the wealth. The same thing is happening in the US. I call it the feudalization of America. You have corporate executives (the New Nobility) and everyone else. The New Nobility believes they are entitled to as much money as they can possibly grab out of their company’s coffers, whether they succeeded or failed as business leaders. This is very similar to rule by divine right, don’t you think? Now if an exec hires an illegal for $4 an hour instead of a gringo for $8 an hour, where do you think that difference goes? In the US, the wealth of the ultrarich is increasing much faster than the wealth of the middle and lower classes. Now, who do you think is harmed the most by the illegal invasion? Low-income black and Hispanic American citizens. Look South; Mexico is in disarray, California is broke because they can’t bear anymore costs of illegal immigration. Right now 1 in 4 Kindergartener’s in this country are Hispanic. Beyond the Social costs look at the costs to country’s infrastructure. Both parties are to blame, especially George W. who allowed them in in droves to satisfy the large corporations that benefit from illegal cheap labor. But back in good ol’ Oregon, let’s encourage as many as possible so that the schools can continually get more and more federal funding. I know, let’s keep raising the min wage in our state so that employers you already cheat the system can continue by hiring large droves and pay them under the table. I wonder what the real amount in lost tax revenue is.

I assume–with zero proof–that the declining fortunes of the newspaper are totally disconnected from its reporting bias.
In today’s employment climate, I suspect that many jobs held by illegals would be acceptable to non-illegals.

Timmytom, don’t be fooled. The Oregonian is collapsing as sure as any other paper. It’s privately held by the Newhouse family, so it’s decline isn’t as public. The audit numbers had them down 8% in the 6 month period ending last fall. They laid off several dozens last fall too.
The high number of online activity is a reflection of the “keep Portland weird” crowd who are pretty unique. They give Air America pretty much their only successful station here. Problem for the Oregonian is no one has yet figured out how to make money off their news websites.

What a bunch of bull! Employers are afraid they won’t have workers???? Helloooo!! Unemployment at record levels, pllleeenty of welfare people to fill jobs. The MYTH that Americans will not take the jobs that the illegals are willing to do is just that. It is not a myth though, that some are uneasy about working with those that do not speak ENGLISH. Since they made those stupid laws regarding kids and labor. Most kids find it a joke to be allowed to work 8 hours a week during school (something like that, I know they have restricted hours). The kids I know would love to plant trees, or pick fruit, but no way would I allow a teenage girl to work in the fields along side some illegal. Get rid of the illegals, non English speaking people, and allow kids to work more hours. Oh, and put these lazy WELFARE moms to work. Quit paying illegals to have more babies, one baby on welfare and that should be it, mandatory birth control or pay for the baby yourself.

My view is that if a person came into this country illegally he/she broke the law and is still breaking the law for every day they continue to stay here. The issue is not that employers are going to be short handed or that Americans won’t take the low paying jobs. These are all issues and problems that have in fact arisen from the illegal immigrants being here breaking laws every day. Our government did not take care of the situation and stopped the illegal immigration when it should have. Now the problem has grown to enormous proportions. The problem has to be resolved no matter how late or how big the issue is. Allowing citizenship in any way shape or form is not resolving any issues. Anyone living here illegally is breaking the law whether it happened today or twenty years ago. What part of “illegal” does our government not understand?My other view is why is this the U.S governments responsibility only. Why are we taking full responsibility when a great number of these people came here from a country in which they are legal citizens. Why are the governments from these countries not taking responsibility for their citizens? Isn’t there some kind of international law that would hold these countries accountable for their citizens migrating in great numbers to the U.S.? I have heard nothing from these countries. In particular Mexico, Cuba or other south american countries. The mexican government for example does nothing for their poorer citizens. They have the means to develop programs or industries to promote their growth in the area of human decency. I feel so ashamed of the mexican government for not caring for its people. That is truly shameful. I wish our media would do some coverage about this on the mexican government. Instead their coverage blames the U.S. for everything. That is so lame.

rocky4321, my own husband has worked for less than $10 hourly and supported a family on it, barely. My 68 year old mother works for barely 10 an hour, and it is a physically grueling job. Please do not use excuses for hiring illegal aliens, you should be prosecuted, under the very laws you are breaking, and you should be put out of business.
Simply said, Oregonians/Americans will work for $10.00 an hour, but let’s be honest rocky4321, we can all bet you aren’t even paying the $10.00 an hour you claim, I can assuredly say it is far lower than that.

EderC-Free markets DON’T mean Open Borders and ignoring the rule of law. If you’re advocating TRUE Free Market Capitalism in a Republic govenment, as this country was designed, then we need to also end the welfare state.
Would illegal immigrants still come if it was opportunity ONLY, with NO U.S. Citizen tax-payer funded safety nets, free education, free health-care, free child care, etc? If they HAD to learn English, instead of us catering to them with Spanish interpreters, our school system catering to their children with special ESL classes, so many jobs requiring “bilingual skills”.

I grew up in the 1940’s in the Central Valley. When I was 6, I used to pick the cotton, left by regular pickers, and hoe cotton, when school was out. Near, Corcoran, and Delano, California, it was about 90% whites, and, 5% blacks, 5% in the cotton fields, and grape patches. My family never got welfare, and we had to work to survive. There were 6 children in my family, and we all worked.My dad died. We moved to Oregon in 1950. My dad had died, without social security, so my Mom got a job in a mushroom factory in Salem.We picked all the crops like strawberries, beans, cucumbers, and berries. We hayed, and hoed too. My Mom was proud, and never think of taking welfare.Often, the school teachers worked as our supervisors, and we were taken to the fields in school buses. The older and stronger children got jobs changing irrigation pipes, and driving tractors. I used to ride my bike 10 miles on a paper route, and then rode another 12 miles to pick berries/ beans. I do not recall ever seeing an Afro-American, or Mexican working in the fields in the 1950’s in Oregon. We Americans can do the work illegals do.I was able to pay my own dental bills, and buy my own clothes, with farm work, along with the other neighborhood children that worked too. The work was less dangerous, than sports that children play now.We finally were able to get cannery jobs, a industry, almost now, wiped out by unwise politics too. All of my family( 6 children ) were able to work our way though Oregon State University, and go to sucessful careers, and old age. Working hard at the farms did not hurt us. Anyway, politics has banned most of this work for young Americans, and the welfare state made work unnecessary. Now, the youngsters are banned from working, or lose welfare for working, and people have lost the values of hard work, and earning a living.I live in San Francisco, and it’s block- to-block illegals, sellng methamphetamine, crack, and heroin, brought in by big time Mexican drug dealers. I suspect about 1/3 of the illegals are selling drugs, and California prisons are about 1/3 illegals.We have about 30 million people, unemployednow, and if we go easy on illegal, we’ll have an overpopulation of 1 billion people someday, so if you care about this country, just say no.I’ve live in Mexico, and Brazil, for many years. People survive there good, and live to about our lifespan, but they don’t have our luxuries, cars, and big houses, and don’t consume so much resources like we do. We will be doing the world a favor, no allowing our over-population by illegals here. The world does not have the resources, to support our big use, by an overpopulation of the USA. I voted for Obama. He is a good speaker, but a greenhorn, whom I am afraid of might make bad decisions, due to the lack of experience. If he brings in the illegals, and gas goes over $6 dollars a gallon, because a bad energy policies… he won’t get my vote the next election.I would support a policy, that lets farm workers come in to work for 6 months a year, or foreign exchange students to work for awhile.Newspapers, need Ben Franklin like, wise people for editors, instead of the greenhorn uninformed, and inexperienced trust fund babies, that now we are getting.

one of the arguments for slavery’s continuation was that the economy would collapse without slave labor…that’s odd, the economy increased exponentially and made the USA more prosperous than ever before. that same tired argument is what is used to keep illegal immigrant labor on the front burner, that business can’t survive without it and the economy would collapse without them. eisenhower had the balls to deport illegals, in fact he deported ‘em in boats so far south that they would have a difficult time getting back, not this drop ‘em over the border so they can hop right back on the next pass. illegals get in for free while many talented legal immigrants are waiting in limbo for approval on their visas, these are engineers and doctors and other educated people who are playing by the rules and getting screwed, so basically our own government gives their full support tothe policy of “it’s only wrong if you get caught”, and if you do get caught but have lots and lots of money? that’s ok too.

The US should impose a ten-year moratorium on immigration. We went from 250 million in 1990 to 300 million in 2005. That’s 50 million in just 15 years! We don’t need to import doctors and engineers from around the world. We simply need to take better of our schools. We also need to shed ourselves of all the guilt the rest of the world has tried to saddle us with. Just because we want to take better care of our own country and rid ourselves of a little excess baggage doesn’t make us evil. We’ve done enough for other countries. Now we have problems here at home.
Mexico pays out $40 billion in federal fuel subsidies so they can fill up their SUVs for cheap. They also give free Viagra to men over 70 in Mexico City. Mexico needs to rearrange its priorities. And men over 70 should not be taking Viagra!

Remember the May Day protest of two years ago??? The boastful and prideful display of the Mexican demonstrators gave us clear evidence of who they are and why?? They’ve destroyed their own country and now they want to escape here – - legality has no real place in their bahavior. I find interesting that with unemployement at 9% or so that these groups want to allow illegals to continue to take American jobs. People that by their own admission send approx 30% of what they earn out of this country. That really helps our economy now doesn`t it. Illegal is Illegal period. The time has come to simply end immigration into this country. Such an act would immediately have positive impact on our economy and quality of life.

I can remember how heartbroken my children were when the State passed the law that would no longer allow them to pull weeds, pick strawberries or any number of jobs that were offered by our local farms. I forcast the demise of small farms at that time and look what has happened. It may have taken a while but now I forcast the demise of farming all together. Our Legislature just can’t leave it’s hands off of a good thing.

Most of the farm workers would like to travel back to Mexico after the farm work is done because the have family there, and cheap to live. The boarder is closed up, and it’s hard to get back and forth, so many just stay here. A Wall Street article said illegals were about 5% of the present, when farm workers could cross legally. Our hero Chezar Chavez didn’t want the Bracero program, so it was eliminated costing the lives of thousand of people in the desert.It costs about about $5,000 to have a baby in the USA, and about $500 in Mexico. The mothers are employed here, but the income is under the table, with no taxes, often, so a citizen from Mexico can have a baby and, instant welfare…food stamps, ADC, etc. because of the child. We need to change these rules.We could offer a work permit for 6 months for farm work at a time, for a fee like $200. A 6 month period per year would prevent people from going on unemployment, like what happened with the last amnesty. We could have a minimum tax of 10% on the employer, and the employee. We can also charge social security taxes, with the usual rules. We can change the citizenship, rules to require 10 years of work before citizenship. We could require a passport e,g. Mexican/ USA, to get any job. We could get the employers for not paying taxes or, following the rules. It may be possible to pay off the Social Security deficient using this kind of model. Most guest workers would return home, after earning some money, sooner, or later.I’d really like to see our own citizens taking these jobs, but who can blame them, if the welfare state gives people free medical care, food stamps, and a rent-free housing for doing nothing.

nafta destroyed many farm jobs in mexico when large agri-biz gobbled up small farms resulting in a large number of mexican laborers who came here. the politicians and their bed buddies call it free trade as if it didn’t cost anything! didn’t cost them anything!
i have a perfect solution for this crisis. if we staff government positions with illegal immigrants then we only have to pay them half as much and no PERS bennies! imagine the hundreds of billions we would save! (please note the sarcasm)

Now, why do athletes “play” in freezing rain and mud? Because they’re paid big bucks. Same with Americans. Pay them enough and they’ll do any job. For that matter, most illegal aliens are NOT out in the fields, but doing jobs Americans definitely do do, such as construction.
As for “guest worker” programs, we already have them, the H2 visas for seasonal agricultural workers and for other unskilled workers. Guess what? As long as employers can get illegal aliens who’ll work cheaper and don’t need paperwork, employers will prefer them to using legal programs.
ENFORCEMENT OF THE LAW IS A PRE-CONDITION FOR ANY PROGRAM, FOR ANY IMMIGRATION POLICY TO WORK. If government can’t or won’t enforce current law, then there’s no reason to believe it would be different with amnesty. In fact, we’ve already seen with the 1986 amnesty that enforcement never gets done–we just get more illegal immigration.

There’s not much I can add that others haven’t said. The author is obviously on the wrong side of the debate, what little debate there is. It’s only the cultural elite, unscrupulously business owners and the politicians they’ve bought off that side with the illegals.
As the author can obviously see, the opinion of the minions, us little uneducated working people, are in violent opposition to amnesty and privileges for illegal aliens.
IN THIS TIME OF RECORD UNEMPLOYMENT, THERE IS NO EXCUSE FOR A SINGLE ILLEGAL ALIEN TO HOLD A JOB IN OREGON. AS THE RAID IN WASHINGTON A FEW WEEKS AGO SHOWS, THERE ARE $30, $40 and $50 AN HOUR JOBS GOING TO ILLEGALS.

Everyone agrees that the borders should be protected…for many reasons other than just job security.
And yes, illegal immigrants entered in exactly that manner..illegally.
But you’re arguing what they represent to current citizens, when we need to look at what is feasible to benefit our citizens.
Are we going to be able to arrest every single illegal alien and deport them? Obviously not in a state that hates to fund state activities.
So yes, prevent new illegals from entering, but make the ones who are already here PAY TAXES!
BTW, we should look at Canada’s immigration policies. They use immigration to BETTER their country. For instance, the LEGAL immigrants that come to the US (Asians & Europeans) are highly skilled and increase our economy and economic diversity.

hate to argue, but my relatives in toronto say its an asian city now, and they dont seem too thrilled about it. also, i saw a bit on tv recently about how hispanics are sneaking into canada from detroit now because canada gives them a year of absolutly free housing plus food and healthcare the minute they show up. thats even better than what they get here. they each get their own apt, no need to share with 12 others… we dont have to arrest them all. if our labor laws were enforced, and new laws were written banning landlords from renting to illegals they would self-deport. no work, no home, see ya!

I think what everyone is forgetting is that we tried Amnesty in 1986. At that time we granted amnesty to around 4 million illegal’s. Look at what that created, 12-20 million now that EXPECT to be granted amnesty. Our immigration system isn’t broken, it’s just our immigration laws have never been enforced by either party. The Repubs because of big business and the Dems for the votes. Neither party listens to what the American citizens want or need, because we aren’t the ones lining their pockets.
As for these groups that are promoting illegal aliens all are guilty of aiding and abetting and should be prosecuted. The churches should be stripped of tax exempt status, the unions should be shut down and anyone that continues to aid and abet illegal’s should be jailed.
The cost of illegal immigration is being carried on the backs of American taxpayers and legal immigrants. Last year alone it cost this country $338 BILLION to support illegal’s. Can anyone think of better ways to spend this money other than on those that shouldn’t even be here? Last year alone more than $23 BILLION was sent back to Mexico by the illegal’s, making this the second largest source of income to that country. Of course Mexico wants illegal’s here, they’re a great source of money for the country. But that money does nothing to help it’s own people and make their lives better. Why is that?
To those that promote illegal’s, all you have left is name calling because your arguments to promote illegal activity are failing. You should be ashamed of yourselves. If you look closely at “LaRaza” you will see that they are the largest racist group in this country. Can you imagine if a group of whites had a motto that stated “For the race everything, for those outside the race, nothing.” I believe they would be called the “K-K-K”, now that’s racist. Those of us that don’t support illegal immigration only want our laws enforced. All we want is our country respected and our sovereignty guaranteed. If that makes us racists in your minds, then so be it.
Our country is crumbling around us and we are losing 650,000 jobs a month. Please wake up and tell your government that illegal immigration will no longer be tolerated by Americans that are struggling to survive. I belive that Americans will do any job if it means their families won’t starve. If American citizens break the laws of this land we expect to pay the consequences for that decision. Why should illegal’s be any different? Yes, we are all humans, but everyone has to obey the law. Just try to live in Mexico illegally and see what happens to you. If we would adopt the immigration laws of Mexico, we wouldn’t have an illegal alien problem.
So if you want America to become a 3rd world country, sit on your backsides and do nothing. But if you want America to survive as the greatest nation on earth, start making noise now to stop the next amnesty that is assuredly being worked on. Start writing letters to your congress rats and tell them we will not allow this to happen. It’s up to all of us to do whatever we can to push for what is good for America and it’s citizens. Demand that those that come here do it legally and give up all allegiance to the country they left behind.

I love a meltdown, and this subject always brings it on.
New Law: If you hire an individual and that person is illegal or not allowed to work (visa restrictions do exist), you pay $100,000 fine Per Person Per Day. If you don’t have the cash, you go to jail and work off your debt at minimum wage (minus room and board including cost of guards). The jobs will immediately disappear.
New Law: If you are here illegally, and have otherwise been employed, paid taxes, stayed out of trouble (with the law), learned English, and tried to assimilate, you should get a path to citizenship, and a preference on legal residency which needs to be filed back in your home country with the US embassy. Then you can return and be a legal resident and hopefully become a productive citizen.
Oh, and all you conservative and liberal pukes out there who love name-calling: You’re all still pukes. Both sides of this debate have valid points, but too much of the argument is couched in rhetoric, and the “NO COMPROMISE” stances guarantee that nothing happens.

Today’s Oregonian front page headline reads, “In Detroit, houses cost less than cars”The story is about housing prices in Detroit, now that most industries and the auto industry are either dead or dying in Detroit.The story wasn’t about the people who used to live in those houses. It was about what a great investment those houses are for investors, domestic and foreign.
My 63 year old sister, in the former industrial state of Ohio, works full time and just bought her home for $1,200. Yes, one thousand two hundred dollars. It’s a trailer home. The southwestern Ohio city she lives in, and where I grew up, has become a ghost town. First the industries went overseas. Then the Mexicans came. The businesses and shopping centers are dropping like flys. The only reason to go downtown is to pay parking fines or do other government business.
Yesterday’s headline story in the Oregonian told of the plight of poor illegal Mexican immigrants in the United States and how several Latino non-profits, the Catholic church and a few Latino and greedy labor unions are uniting to help the illegal Mexicans. This makes me want to vomit.
Why are not the poor of Americas’s inner cities, dying former industrial cities, Appalachia and the poor rural south receiving the efforts of the Latino non-profits, Latino and greedy labor unions, the Catholic Church and the Oregonian?

Two-year-old ( mexican Anchor baby) Gabriel Rosas-Vargas was killed Monday afternoon after running into a Woodburn street and being struck by a pickup. Later that night, police arrested 23-year-old Victor Garcia Hernandez. Hernandez was arraigned Tuesday on charges including DUI and hit-and-run. They said additional, more serious charges were likely.

In a probable cause statement obtained by KGW, a woman claimed she saw Hernandez hit the child.

Lisa Itel told the court she observed the toddler as he was struck by the pickup truck. Hernandez got out of his vehicle and approached the toddler, who was lying in the street, Itel said.

Hernandez “stood there for a while, talked on his cell phone and then got in his car and left the area,” Itel said.

The witness statement contradicted claims by Hernandez that he did not know he’d hit the child.

The toddler was with his family at a store near the intersection of Front and Harrison streets around 4 p.m. Monday when he ran into the street and was hit by a white GMC truck, which drove away from the scene after the impact, according to police reports.

The Mexican anchor baby died at the scene.

Prosecutors say Hernandez was under the influence of cocaine and marijuana at the time of the incident, and that Hernandez had used cocaine on Sunday night. They also said he had been stopped twice before for driving under the influence of illicit substances. He was charged with DUI on New Year’s Day 2006, when he was 21, but was released after a 2008 traffic stop. No charges were filed after the second stop.

The defendant’s license was suspended after the 2006 arrest and then reinstated May 1 of that year. He entered a guilty plea and also completed a year-long diversion program that included alcohol treatment.

Hernandez was being held on a $500,000 bail.

Hernandez’s truck was later found on Highway 99E near Industrial Avenue in Hubbard.

Senate Again Shows Incredible Insensitivity to Jobless Americans (but this E-Verify fight moved the cause forward)

Of course, it was disappointing to lose the E-Verify battle this evening 50-47 when a switch of only two votes would have won it.

But in this temporary defeat, we see many signs of winning the longer-term battle for E-Verify to take away the jobs magnet from illegal immigration. I’ll tell you the reasons for optimism — and tell you which Senators were the biggest sell-outs of unemployed American workers.

Because of our side’s relentless campaign for E-Verify since last summer, the Democratic leadership included in this Omnibus bill a 6-MONTH extension that will keep the program from dying this month as had been scheduled. We wanted a 5-YEAR extension, but the program is not going to die.

WHAT NEXT?

Commenters below — even as I am writing this — are walking off today’s battlefield and asking ”what next?” They are ready immediately to fight some more for the some 7 million Americans who are unemployed because millions of illegal aliens are allowed to hold U.S. jobs. Good for you!

Majority Leader Reid and 49 of his fellow Democrats voted today in favor of the illegal foreign workers and their outlaw employers — and against unemployed Americans. But frankly, I don’t think many of them had their heart in it. In fact, I’ll explain later that I think a lot of Democrats cringed as they cast their votes today with your weeks of pleading phone calls perhaps ringing in their ears.

I have just sent an Action Alert by email to all of you registered members of NumbersUSA, outlining the next steps. Your NumbersUSA Capitol Hill Team is already working on leveraging some behind-the-scenes activity today.

SENATE LEADER REID HAD LOCK ON BLOCKING SESSIONS AMENDMENT

Every Republican but the ill Sen. Johanns of Nebraska (who didn’t vote) voted NO to tabling the long-term E-Verify extension.

The 7 Democrats who joined the Republicans in supporting jobless American workers were:

Bayh of Indiana
Klobuchar of Minnesota
McCaskill of Missouri
Baucus and Tester of Montana
Nelson of Nebraska
Webb of Virginia

We are most pleased with their vote and will give them good points toward their immigration grade. But the way they did it makes them less than heroes in our eyes.

Six of the seven were among the 15 Democrats who voted against the Bush/Kennedy/McCain amnesty of 2007. Klobuchar is the real surprise today, having voted for the amnesty and having a D-minus immigration grade.

If you were watching C-SPAN during the vote, you probably noticed something odd about the 7 Democrats who voted with us, casting a NO on tabling the E-Verify amendment. That is, most of the 7 (maybe all) first voted YES. But at the end, they huddled with Reid’s leadership team and began changing their votes to a NO.

What was going on was that Sen. Reid was demanding almost absolute discipline from his Democrats. The ones who felt like they needed to vote NO on our side let Reid know ahead of time, but most of them consented to vote YES if Reid required it of them.

Thus, nearly all Democrats initially voted YES (to kill the E-Verify amendment). Then, once Reid knew exactly how many YES votes he could give up and still have 50, he began allowing some of the Democrats to vote NO.

Presumably, Reid allowed a NO vote from the Democrats who were under the most pressure back home to vote NO.

So, I would say those of you in Indiana, Minnesota, Missouri, Montana, Nebraska and Virginia should feel highly complimented that Sen. Reid apparently feared you the most.

TOP 20 DISAPPOINTMENTS AMONG SENATORS

Of the 50 Senators who voted against assuring businesses and states that E-Verify is here to stay, 30 routinely vote to encourage foreign workers to come to the U.S. to take jobs illegally. I am not suggesting that these Senators are hopeless, but they behaved true to form today.

But there are reasons that we could have expected more out of the other 20. If only two of the following 20 Senators had voted NO today, we could have won today.

NO. 20 BIGGEST DISAPPOINTMENT – Democratic Senator Burris of Illinois was recently picked by the disgraced governor to serve out Pres. Obama’s Senate term. Discussions between him and the governor have cast questions about the appointment and caused other Senate Democrats to distance themselves from him. One argument that Burris has given for why he is so important in the Senate is that he is the only African-American and needs to give voice to special needs of Black Americans throughout the country. The latest federal stats show that Black Americans are suffering by far the worst unemployment, but in the face of voting for the E-Verify system to open up jobs held by illegal aliens, Burris stood against unemployed Blacks and other Americans.

NO. 11 through 19 – The other Democrats who were elected for the first time last fall or appointed this year to fill out terms. Even though most of these Senators previously told the public that they believed in preventing unscrupulous employers from hiring illegal workers, not a single new Democratic Senator stood for enforcement today. Their first immigration act in the Senate was an anti-enforcement act. Every Freshman Democrat started his/her immigration record on the side of illegal foreign workers. That was the shame for …

NO. 7 through 10 — Four Democratic Senators who voted against the massive Bush/Kennedy/McCain amnesty in 2007 because of populist concerns about the effect on American workers. These were four Senators who we have not usually been able to count on to take this stand, but because they were among the 15 Democrats who in 2007 stood against their Party’s obsession with flooding U.S. occupations with foreign workers, we had begun to expect more out of ….

NO. 6 BIGGEST DISAPPOINTMENT – Senator Stabenow of Michigan. She got into the Senate in 2000 because our side hammered the Republican incumbent Senator Abraham for his aggressive preference for foreign workers over Americans. Since then, she has tended to side with American workers on these close, important immigration votes (including opposing the 2007 amnesty). Not today, even though her state has the worst unemployment in the nation.

NO. 4 and 5 — Senators Byrd of West Virginia and Dorgan of North Dakota. What happened? Both are well ensconced in their states, but how could the citizens have not persuaded them to do what they usually do. In most years, no Democrat has been more likely to stand for American workers against the importation of foreign workers than Byrd and Dorgan (who have fought against all amnesties). But today, Reid needed their votes to protect illegal aliens and Byrd and Dorgan gave theirs to him.

NO. 3 — Senator Gillibrand of New York turned her back on her previous record and seemed to prove that the screaming New York City illegal immigration groups have truly gotten control of the recently appointed Senator. As a Member of the U.S. House, Gillibrand had been one of the 50 or so more agressive Democrats in opposing illegal immigration and in demanding mandatory E-Verify for all businesses. But as soon as she was appointed Senator, the illegal immigration groups met with her and demanded she change her ways. And that she did today.

NO. 1 and 2 — Senators Pyror of Arkansas and Landrieu of Louisiana needed our side to see them as pro-American-worker Democrats as they ran for re-election last year. We gave them a lot of pats on the back and recognition for taking the lead in introducing the SAVE Act in the Senate to mandate the use of E-Verify for all employees in America. But now that they have been elected for another six-year term, they turned their back on E-Verify today when their two votes alone would have won the long-term extension.

TODAY WAS A GOOD STEP FORWARD

If you live in the states with the Disappointing Democratic Senators, we will give you ample opportunity to express your opinion of their behavior today.

Nonetheless, I think we moved forward even in our narrow defeat today.

If you watched the debate, you noticed that the opposition really didn’t criticize E-Verify. In fact, most of the Senators arguing against the 5-year extension were just saying that today was the wrong time to do it and that the Omnibus was the wrong vehicle. Several even said they favor long-term expansion.

Absent from the remarks were the falsehoods we see so often in the mainstream media in quotations from the ACLU, immigration attorneys and religious leaders. I didn’t hear talk of E-Verify being riddled with errors or rife with discrimination or threatening of falsely firing U.S. citizens.

If all of you respond strongly enough to the bad votes from your Senators today, we may be close to congressional leadership deciding that it is time to just get this issue out of the mix and pass a long-term reauthorization.

It was clear in the debate this afternoon and evening that the E-Verify amendment was an inconvenience for those who were insisting on ramming the giant Omnibus spending bill through Congress. Unfortunately, being out of work because more than 7 million illegal aliens have U.S. jobs is a lot more than an inconvenience for unemployed Americans.

HILLSBORO, Ore. — A judge has sentenced a Beaverton landlord to a month and a half in jail for sexually abusing a former tenant who was mentally ill.

Moji Momeni, 49, a Beaverton apartment owner charged with sex abuse.

Fifty-year-old Moji Momeni has no prior convictions. He is listed as the owner of more than 15 properties in Beaverton.

Momeni was convicted earlier this month of three counts of sexual abuse, after the victim testified that he forced her to perform a sex act in exchange for not paying her 575 dollars in rent.

Three former tenants, all women, testified during the two-day bench trial that Momeni made inappropriate comments to them and touched them in ways that made them uncomfortable.

None of those instances resulted in criminal charges.

Four people testified on Momeni’s behalf, including two tenants who said he was kind and fair.

Momeni was also sentenced to five years of probation and must register as a sex offender.

Momeni has described the incident with the woman as a misunderstanding, and says he should not have allowed it to happen.

Jury awards Beaverton woman $855,000 from former landlord

A Washington County jury has decided that a Beaverton woman should be paid $855,000 by her former landlord after he forced her to perform a sex act with him in exchange for back rent.

The verdict against Moji Momeni and his company, CJR Inc., which owns 15 apartment buildings, mainly in Beaverton, was handed down Friday by a Washington County Circuit Court jury. The defendant’s name is being withheld by The Oregonian because of the nature of the allegations.

She sought, and was awarded, $55,000 in economic damages to reimburse her for past and future expenses. She sought $5 million each for non-economic and punitive damages. The jury awarded her $280,000 for non-economic damages – to compensate her pain and suffering – and $520,000 in punitive damages to punish Momeni for his behavior.

The Circuit Court decision follows a criminal conviction last October. Momeni, 51, was convicted of three counts of third-degree sexual abuse. He was sentenced to 45 days in jail and was designated a sexual offender.

The civil suit arose from the same incident. On Dec. 17, 2005, the victim went to Momeni’s Beaverton office at 12190 S.W. Longhorn Lane to discuss $575 she owed in back rent. Momeni forced the woman, a single mother who suffered bipolar disorder, to perform oral sex to eradicate the debt.

This was verified by a member of the IRC in a phone call yesterday.

The Obama administration may be planning to house millions of Mexico’s citizens, fleeing the Mexican drug wars, in tent cities on the U.S. side of the border with Mexico.

Designating the illegal aliens as ‘refugees’, Obama may release millions of Mexican citizens into our country. Obama will try to convince the American people that Mexico is so dangerous that it would be ‘inhumane’ to send the so-called ‘refugees’ home.

Amnesty will be justified as the only recourse for these ‘refugees’ and the 20-30 million illegal aliens already residing in America.

Certain facts expose the Obama agenda:

Obama could easily put the military/national guard at the border to stop the flow of drugs into the U.S.

Although the Obama administration says nowhere in Mexico is a safe haven for citizens, this too is a falsehood. The warring factions are concentrated in northern Mexico, along the border—frightened citizens could relocate within their own country, but Obama may be implementing a plan that will bring them into the United States instead.

There is no plausible reason to treat them as ‘refugees’.

Guns from America are being blamed for arming the drug cartels, but the Mexican government will not release the serial numbers of guns that have been confiscated according to Tom Tancredo in a Larry King Live interview on March 28, 2009. He states the guns are being supplied by the Mexican army.

“It just doesn’t seem rational,” is how I was quoted in today’s New York Times front page story about Pres. Obama supposedly being committed to moving a mass amnesty forward this year. So, for about the next 12 hours, I answered phone calls from print reporters and did radio shows across the country.

Despite the Times’ very difficult financial position and the hatred it evokes from a sizable part of the public, you can quickly understand its continuing power over the nation’s media when you are quoted in one of its controversial stories.

Every time it happens to me, my phone literally is ringing all day long from reporters, talk hosts, bloggers, researchers, foreign press, Hispanic press.

The New York Times still sets a lot of the agenda of the whole nation’s news media.

What got things going today was Julia Preston’s story that quoted a “senior administration official” under the headline:

Obama to Push Immigration Bill as One Priority

By the end of the day, nearly every open-borders group in America had sent out mass emails declaring victory and calling on their members to call the White House to tell them not to listen to the protests from groups like NumbersUSA.

Part of their excitement, no doubt, was that one of their own was the “senior administration official” delivering the pro-amnesty news. Cecilia Muñoz, deputy assistant to the president and director of intergovernmental affairs in the White House, was until recently a vice president of the National Council of La Raza

Reporter Preston clearly understood that the chief problem with Munoz’s pro-amnesty comments was how they played against the nation’s terrible unemployment problem. She wrote this:

Opponents of legalization legislation were incredulous at the idea that Mr. Obama would take on immigration when economic pain for Americans is so widespread.

“It just doesn’t seem rational that any political leader would say, let’s give millions of foreign workers permanent access to U.S. jobs when we have millions of Americans looking for jobs,” said Roy Beck, executive director of NumbersUSA, a group that favors reduced immigration. Mr. Beck predicted that Mr. Obama would face “an explosion” if he proceeded this year.
“It’s going to be, ‘You’re letting them keep that job, when I could have that job,’ ” he said.

In all my interviews today, I talked about two numbers that illustrate starkly the irrationality — and callousness — of any move toward an amnesty this year.

6 million — That is the estimate of illegal aliens who are holding down non-agricultural jobs in the U.S. Most of them are working in manufacturing, service and construction jobs that require no more than a high school education.
Nearly 7 million — That is the number of Americans with no more than a high school education who are looking for jobs (primarily in manufacturing, service and construction) but can’t find one.

Cecilia Munoz is suggesting that her boss, Pres. Obama, thinks it is a good idea to tell those 7 million unemployed Americans that the jobs they want should continue to be occupied (permanently) by 6 million illegal foreign workers!

I’m hoping that is not Mr. Obama’s idea at all but what we were seeing was the result of Munoz drawing the short trial balloon and being the one who had to publicly float it to see if the American public is distracted enough not to notice what a crazy idea that would be.

But Cecilia wasn’t the only one trying to sell nonsense. Reporter Preston quotes other Administration officials as saying that . . .

. . . Mr. Obama’s plan would not add new workers to the American work force, but that it would recognize millions of illegal immigrants who have already been working here.

That is another trial balloon to see if the public believes that illegal immigration is a victimless crime. Every manufacturing, service and construction job an illegal alien is allowed to keep tends to mean that an American stays unemployed. Now that sounds like a good campaign theme for congressional re-elections.

Of course, maybe I was floating a trial balloon myself in talking about “an explosion” if Pres. Obama pushes an amnesty this year. I am depending on Americans to stand up for themselves and speak up. We certainly will give everybody a chance to do so through our Action Buffet system. If you haven’t told the White House what you think of Cecilia Munoz’s comments this week, please do so now.

Cecilia says Mr. Obama will speak to the nation about his amnesty plans in May and then will bring “immigration groups” and other experts together during the summer to hammer out a plan.

But the Times story details no promise of bringing the amnesty to a vote this year.

I think the White House is waiting to judge the public’s reactions to the amnesty efforts before committing itself. If Americans sit on their hands every time a White House Official says something irrational about immigration, then the irrational may start to seem rational.

Looks like Mr. Obama may be depending on you to help him stand up to the irrational open-borders groups.

News Release

On Tuesday, May 12, 2009 at 10:08 a.m. a witness reported to the Clackamas County Sheriff’s Office, observing a male subject ‘discarding a soiled mattress’ onto the highway overpass located on SW 65th, above Highway 1-205 (20590 SW 65th / propped against a guard rail).

This watchful witness provided a suspect and suspect vehicle description; which included the suspect vehicle license plate number. Most disturbing was what the witness reported to be emblazoned with spray paint on this discarded mattress – “Mexican Swine Flu Mattress”.

A Clackamas County Sheriff’s Patrol Deputy soon met with a Washington County Sheriff’s Deputy, with respect to the close jurisdictional boundaries and verified the crime actually occurred in Clackamas County. In addition, it was also discovered the registered owner of the suspect vehicle address was identified to possess a Washington County address – located within close proximity to the crime scene.

Sheriff’s Deputies responded to the address of the registered owner of the witness described suspect vehicle. This suspect vehicle was soon discovered at the residence and determined to be a: 1981, Toyota, Pick-up truck, yellow in color.

The registered owner of this vehicle is the suspect; who is identified as: Gerhard Franz Gebert, age 52; who resides at 7170 SW Robbins Road, in Tualatin (Washington County).

The investigating Clackamas County Sheriff’s Deputy interviewed Gerhard Franz Gebert, who admitted to inscribing “Mexican Swine Flu Mattress” and discarding this soiled mattress onto the overpass location.

Gebert indicated that this particular mattress had been discarded on his neighbor’s property for over a month, and felt it would be funny to inscribe “Mexican Swine Flu Mattress” while discarding the mattress along the roadway. Gebert indicated he feels the Hispanic Community is partially responsible for littering in the area and wanted to bring this to their attention. (Photos Attached)

This song is called Alice’s Restaurant, and it’s about Alice, and the restaurant, but Alice’s Restaurant is not the name of the restaurant, that’s just the name of the song, and that’s why I called the song Alice’s Restaurant. You can get anything you want at Alice’s Restaurant You can get anything you want at Alice’s Restaurant Walk right in it’s around the back Just a half a mile from the railroad track You can get anything you want at Alice’s Restaurant Now it all started two Thanksgivings ago, was on – two years ago on Thanksgiving, when my friend and I went up to visit Alice at the restaurant, but Alice doesn’t live in the restaurant, she lives in the church nearby the restaurant, in the bell-tower, with her husband Ray and Fasha the dog. And livin’ in the bell tower like that, they got a lot of room downstairs where the pews used to be in. Havin’ all that room, seein’ as how they took out all the pews, they decided that they didn’t have to take out their garbage for a long time. We got up there, we found all the garbage in there, and we decided it’d be a friendly gesture for us to take the garbage down to the city dump. So we took the half a ton of garbage, put it in the back of a red VW microbus, took shovels and rakes and implements of destruction and headed on toward the city dump. Well we got there and there was a big sign and a chain across across the dump saying, “Closed on Thanksgiving.” And we had never heard of a dump closed on Thanksgiving before, and with tears in our eyes we drove off into the sunset looking for another place to put the garbage. We didn’t find one. Until we came to a side road, and off the side of the side road there was another fifteen foot cliff and at the bottom of the cliff there was another pile of garbage. And we decided that one big pile is better than two little piles, and rather than bring that one up we decided to throw our’s down. That’s what we did, and drove back to the church, had a thanksgiving dinner that couldn’t be beat, went to sleep and didn’t get up until the next morning, when we got a phone call from officer Obie. He said, “Kid, we found your name on an envelope at the bottom of a half a ton of garbage, and just wanted to know if you had any information about it.” And I said, “Yes, sir, Officer Obie, I cannot tell a lie, I put that envelope under that garbage.” After speaking to Obie for about fourty-five minutes on the telephone we finally arrived at the truth of the matter and said that we had to go down and pick up the garbage, and also had to go down and speak to him at the police officer’s station. So we got in the red VW microbus with the shovels and rakes and implements of destruction and headed on toward the police officer’s station. Now friends, there was only one or two things that Obie coulda done at the police station, and the first was he could have given us a medal for being so brave and honest on the telephone, which wasn’t very likely, and we didn’t expect it, and the other thing was he could have bawled us out and told us never to be see driving garbage around the vicinity again, which is what we expected, but when we got to the police officer’s station there was a third possibility that we hadn’t even counted upon, and we was both immediately arrested. Handcuffed. And I said “Obie, I don’t think I can pick up the garbage with these handcuffs on.” He said, “Shut up, kid. Get in the back of the patrol car.” And that’s what we did, sat in the back of the patrol car and drove to the quote Scene of the Crime unquote. I want tell you about the town of Stockbridge, Massachusets, where this happened here, they got three stop signs, two police officers, and one police car, but when we got to the Scene of the Crime there was five police officers and three police cars, being the biggest crime of the last fifty years, and everybody wanted to get in the newspaper story about it. And they was using up all kinds of cop equipment that they had hanging around the police officer’s station. They was taking plaster tire tracks, foot prints, dog smelling prints, and they took twenty seven eight-by-ten colour glossy photographs with circles and arrows and a paragraph on the back of each one explaining what each one was to be used as evidence against us. Took pictures of the approach, the getaway, the northwest corner the southwest corner and that’s not to mention the aerial photography. After the ordeal, we went back to the jail. Obie said he was going to put us in the cell. Said, “Kid, I’m going to put you in the cell, I want your wallet and your belt.” And I said, “Obie, I can understand you wanting my wallet so I don’t have any money to spend in the cell, but what do you want my belt for?” And he said, “Kid, we don’t want any hangings.” I said, “Obie, did you think I was going to hang myself for littering?” Obie said he was making sure, and friends Obie was, cause he took out the toilet seat so I couldn’t hit myself over the head and drown, and he took out the toilet paper so I couldn’t bend the bars roll out the – roll the toilet paper out the window, slide down the roll and have an escape. Obie was making sure, and it was about four or five hours later that Alice (remember Alice? It’s a song about Alice), Alice came by and with a few nasty words to Obie on the side, bailed us out of jail, and we went back to the church, had a another thanksgiving dinner that couldn’t be beat, and didn’t get up until the next morning, when we all had to go to court. We walked in, sat down, Obie came in with the twenty seven eight-by-ten colour glossy pictures with circles and arrows and a paragraph on the back of each one, sat down. Man came in said, “All rise.” We all stood up, and Obie stood up with the twenty seven eight-by-ten colour glossy pictures, and the judge walked in sat down with a seeing eye dog, and he sat down, we sat down. Obie looked at the seeing eye dog, and then at the twenty seven eight-by-ten colour glossy pictures with circles and arrows and a paragraph on the back of each one, and looked at the seeing eye dog. And then at twenty seven eight-by-ten colour glossy pictures with circles and arrows and a paragraph on the back of each one and began to cry, ’cause Obie came to the realization that it was a typical case of American blind justice, and there wasn’t nothing he could do about it, and the judge wasn’t going to look at the twenty seven eight-by-ten colour glossy pictures with the circles and arrows and a paragraph on the back of each one explaining what each one was to be used as evidence against us. And we was fined $50 and had to pick up the garbage in the snow

SOUTHEAST – State police today said they were continuing to investigate the actions of Zacaria Conses-Garcia leading up to the moment when, police say, he struck and killed a mother and her young daughter as they were walking out of the child’s dance class yesterday. “We’re still trying to piece together his whereabouts, how long he’d been driving, where he’s coming from,” state police Lt. Dominick Chiumento said. Conses-Garcia, who police said worked on a farm in North Salem and Florida, was charged with one count of first-degree vehicular manslaughter, a felony, and driving while intoxicated. Police are arresting them and watching as judges let them out for a fraction of the penaltity they give you. I have been there and seen it. Kentucky had a female judge that got fed up with anonymous people using different names each week in court and jailed fifteen illegals until they identified themselves. The apeal court lambasted her and set them free. We need a new judiciary that isn’t afraid of Bush/Obama. They all think that they are going to get federal appointments if they rule politically.

Here is the explanation and justification for saying that the federal government brings in 1.5 million new foreign workers each year (125,000 a month) to take U.S. jobs while Americans lose theirs. (This is a key number in our national TV ad campaign.)

For months, the open-borders blogosphere has insisted that NumbersUSA is telling tall tales when we talk about these numbers. Most of the commentators and open-borders politicians even claim that we have no source for our information.

So, once again, let us lay out the federal government’s own data.

All the data in this blog represent the most recent 12 months for which government data are available.

At NumbersUSA, we always go with well-sourced, mainstream numbers, even though there may be credible arguments for numbers that make our case even better. As you will see, we have been going with a rather moderate number to describe the insanity of a federal government importing foreign workers to take a dwindling number of jobs while increasing numbers of Americans lose their jobs.

NEW PERMANENT & TEMPORARY WORK PERMITS — 160,000 PER MONTH

That is the number of PERMANENT work permits given in the form of green cards to working-age immigrants over the 12-month period.

None of these people has ever gotten a green card before.

These green cards are the most insidious aspect. Every year, our federal government hands out PERMANENT access to U.S. jobs to nearly a million foreign adults through our legal immigration system. In 2008 while our economy was suffering the worst collapse since the Great Depression, our government continued to flood the occupations of beleaguered U.S. workers at this incredible pace.

Lots of people in think tanks that ought to know better have thrown ridiculous accusations at us, such as claiming that the feds can’t possibly have given 951,000 green cards to immigrant workers since the law only allows greencards to 140,000 skilled and 5,000 unskilled workers per year.

This is the kind of deception that the high-immigration people often use. Most immigrants don’t come on employment visas but through lottery, family, refugee and chain migration categories. What, these adults don’t take jobs, they just go on welfare?

In fact, all immigrants (employment-based or otherwise) enter the job market at even higher rates than American natives. And that’s a big problem when there are 951,000 of them a year during a Jobs Depression.

That is the number of new TEMPORARY work permits given to foreign workers who were getting them for the FIRST time during the most recent reported 12 months.

Many, many more foreign workers were getting work permit renewals during the 12 months, which also didn’t make any sense. But because we are moderate in the way we state our numbers, we haven’t been counting the renewals. We just count the new people getting the temporary permits.

That is the total number of separate foreign citizens who were either getting a new temporary work permit or getting a permanent green card.

Our federal government had the choice to not bring in a single one of these competing workers.

Instead, it gave out nearly 1.9 million new work permits to 1.9 million separate foreign workers.

1.5 million a year

This somewhat smaller number counts how many of the 1.9 million had not already been working in the United States.

The U.S. Office of Immigration Statistics reports that 57.9% of adult green card recipients were already working in the U.S. The feds had the choice not to give them permanent access to U.S. jobs but did, to the detriment of U.S. workers. Nonetheless, most of them are not technically “new recipients of foreign-worker visas.”

But about 100,000 to 250,000 of them were new recipients because they were working here illegally and had not previously had a work permit.

The Center for Immigration Studies prepared a very helpful chart based on the government data. Just click on the image of it for an enlarged version that you can read.

The chart shows how many new temporary workers came for 14 different temporary work visa categories.

It then shows the government’s figure of 396,265 working-age green card recipients who had not previously been living in the U.S.

And it estimates that an additional 100,000 to 250,000 of the working-age green card recipients had been in the U.S. illegally but had never previously had a work permit.

The end result is a range between 1,443,265 and 1,593,605 who were new foreign workers with the legal right to take a U.S. job.

A nice round, medium number is 1.5 million which — as the above stats and math show — is a highly-sourced, credible approximation of the magnitude of damage the federal immigration programs are doing to unemployed Americans.

125,000 a month

1.5 million divided by 12 gives you 125,000 a month.

Using the most recent 12-month statistics in every category of available government data (primarily 2008), that is how many foreign workers the feds have given first-time work visas to — EACH MONTH.

I have seen little effort to reduce this foreign-worker importation.

And I have seen considerable effort by Congress and the Administration to keep the importation as high as possible while talking about the need to increase it.

You should feel free to use the 160,000-a-month figure for the separate new green cards and new temporary work permits given. Just be sure that you know that about 35,000 a month are green cards to foreign workers who already were here on temporary permits.

NumbersUSA is using the more-conservatively-stated 125,000-a-month figure for “new foreign workers.”

Will the high-immigration think tanks and advocacy groups ever admit to these facts? Or will they continue to try to convince their constituents that our immigration policies only bring in a handful of workers?

Deputies arrested a man who accosted a 17-year-old girl on a Tri-Met bus and then followed her to her house and assaulted her. The girl was not seriously injured and the man has been booked into the Washington County Jail.Details of Event:
On Monday, August 17, 2009, at about 7:00 p.m., a 17-year-old girl was riding the number 67 bus toward PCC Rock Creek. While on the bus,Rodolfo Claudio Marquez a man later identified as 23-year-old -, starting flirting with her. She did not return the flirtation and tried to ignore him. Mr. Claudio-Marquez continued and the girl felt uncomfortable by his advances.

When the girl got off the bus at NW Springville Road and NW 173rd Avenue, Mr. Claudio-Marquez also got off and started to follow her. She started to walk south on SW 173rd Avenue into a residential area toward her house. Mr. Claudio-Marquez continued to follow her and talk to her. She told him to leave her alone, but he refused and offered to take her to buy alcohol.

The girl arrived at her house and told Mr. Claudio-Marquez to leave, instead he grabbed her roughly around the waist and pulled her toward him. Mr. Claudio-Marquez tried to kiss the girl, but she pushed him away. Mr. Claudio-Marquez came back at her and punched her in the face with a closed fist. The girl ran into her house and told him she was calling the police, Mr. Claudio-Marquez left the area.

The girl called her father who came directly home. She gave him a description of the suspect and her father was able to locate him near the bus stop at NW 173rd Ave. and NW Springville Rd. Her father called 911 and Washington County Sheriff’s Deputies were dispatched to the area. The father returned home to be with his daughter and when deputies arrived Mr. Claudio-Marquez was not at the bus stop. After searching the area, deputies were able to locate Mr. Claudio-Marquez on the PCC campus near the sports complex. He perfectly matched the description that was given by the victim. The victim later confirmed that Mr. Claudio-Marquez was the same man who had assaulted her.

Mr. Claudio-Marquez was arrested and taken to the Washington County Jail where he was booked on charges of Assault IV, Harassment, and Sex Abuse III. He is also being held on a probation violation for a previous Methamphetamine charge.

Following a two month long investigation by the Salem Police Department, The Oregon Department of Justice, and the Oregon Department of Consumer and Business Services;Mexican Julian Ruiz, 38 years of age, of Keizer, was arrested about 9:00 this morning by Salem Police Department detectives at River Rd. and Brooklake Rd. NE.

Mexican National Ruiz had been a mortgage loan originator at America One Finance, which has since gone out of business. In 2006, he is alleged to have financed a home in the 900 block of Camelot Dr S for $376,000 using the stolen personal information of a customer. That residence fell into foreclosure in 2007.

In 2008,Mexican Ruiz again allegedly stole another customer’s personal information to finance a home in the 3700 block of Illahe Hill Rd S for $417,000. This home has also since fallen into foreclosure.

Mexican Ruiz was lodged at the Marion County Correctional Facility charged with Mortgage Fraud, Aggravated Identity Theft, Aggravated Theft I by Deception, Forgery I, and Issuing a False Financial Statement.

Two mexicans a 60 year old woman and her 4 month old anchor baby, were killed and three other family members injured Sunday morning when the car in which they were riding crashed along I-84 approximately 25 miles east of Baker, Oregon.

On September 27, 2009 at approximately 6:25 AM a 2001 Ford Explorer driven by Raul MENDOZA-LOPEZ, age 25 of Nampa, Idaho was eastbound on I-84 near milepost 331. Four other occupants were also riding in the Explorer. Riding in the right front passenger seat was Juana LOPEZ-LOPEZ, age 60 of Nampa, Idaho. Hahir Emmanuel MENDOZA-LOPEZ, age 4 was seated in a child booster seat in the left rear passenger seat. Seated next to him in the rear center passenger seat was his mother Mireya LOPEZ, age 23. Seated in the right rear passenger seat utilizing a rear facing infant seat was Jonathan MENDOZA-LOPEZ, age 4 months. All occupants of the vehicle were members of the same imediate family with the exception of Juana LOPEZ-LOPEZ who was the grandmother.

As the Ford Explorer was eastbound it drifted to the left onto the gravel shoulder of the center median. Raul MENDOZA-LOPEZ attempted to steer the Explorer back onto the roadway, overcorrected and drove back across both eastbound lanes. The Explorer drove off the south shoulder of I-84, rolled several times down an embankment and came to a rest approximately 50 feet from the freeway.

Juana LOPEZ-LOPEZ, who had been wearing a seatbelt died at the scene of the crash. Jonathan MENDOZA-LOPEZ was ejected from the vehicle and also died at the scene of the crash. While Jonathan MENDOZA-LOPEZ had been riding in an infant seat, it appears that the seat may not have been properly installed. Raul and Hahir Emmanuel MENDOZA-LOPEZ, who were both using safety restraints, were transported by the Baker City Fire Department to Saint Elizabeth hospital in Baker City for treatment of non life threatening injuries. Mireya LOPEZ, who also had been wearing a safety belt, was transported via Life Flight to Saint Alphonsus Hospital in Boise, Idaho where she was treated for injuries and later released.

Eastbound lanes of I-84 were partially blocked for approximately 6 hours while emergency crews responded to and investigated the crash.

Troopers from the Oregon State Police (OSP) Baker City Worksite and a Crash Reconstructionist from the OSP Ontario Area Command are continuing the investigation into the crash. OSP was assisted at the scene by The Huntington Fire Department, Baker County Sheriff’s Office and the Oregon Department of Transportation.

The Police Department divorced itself from a federal deal Thursday that gave it access to federal criminal databases and granted two officers the power to act as immigration officials.

The department pulled out of the agreement after Immigration and Custom Enforcement pushed to expand Framingham’s immigration enforcement role.

The federal government wanted to change the agreement by requiring local police to help issue immigration detainers and assist in deportations.

Police say that could alienate an already reticent immigrant community.

“We want them to report crimes,” said Police Chief Steven Carl. “We want them to call us when they’re victims. We don’t want them to be afraid of us. If we participated in the full (program), they’d be terrified of us.”

ICE’s wish would also have stretched an already understaffed department and cost a cash-strapped town more money, Carl said yesterday.

The original memo of understanding allowed Framingham Police to tap into a database to help investigate violent crimes.

Police spokesman Lt. Paul Shastany acknowledges the department has been caught in the middle of a debate on immigration enforcement. Some say the police are doing too much, others charge they’re not doing enough.

That division was reflected in the community as the news of Framingham dropping out of the federal program broke late yesterday.

Vera Dias Freitas, a local leader in the Brazilian community, said it is “wise that Framingham is pulling out of the program.”

“The reality is the existence of immigrants is everywhere,” she said. “What needs to be done is immigration reform where people are able to find a pathway to citizenship. No one wants to be living in the shadows. We should be looking for ways to support such reform.”

Town Meeting member Dan Gittelsohn is on the opposite side.

He thought the federal government should allow every town and city to investigate and deport “any illegal alien in this country.” He thought that would better protect “every legal citizen of this country.”

Gittelsohn said he is outraged existing immigration laws are not enforced more stringently.

The program was better than nothing, he said, adding, “In defense of the Framingham Police Department, financially, I understand why they’re having a hard time with this.”

Framingham entered into the program, known as 297(g), in August 2007 because of crimes that were going unreported, said Shastany.

“Oftentimes people within the Brazilian community would know of a person who was using an alias and they would be reluctant to talk to us,” said Shastany.

The original agreement allowed police to tap into databases that can shed light on violent felons, human or drug smugglers, gang members or immigration fugitives. Some such criminals use aliases, so their names do not show up in the state or FBI databases typically used by local authorities.

Shastany cited two high-profile crimes – a death stemming from a botched black market liposuction in 2006 and a fatal domestic assault that same year – where Brazilians in the community did not go straight to the police to report a crime, despite the fact that Brazilians were victims.

“This was a way for us to use the information that we would not get during an investigation,” said Shastany. “Otherwise, we had no means to find out who people are.”

The intent of the program was to help solve “crimes involving gangs, guns, violent drug-related crimes, violent domestic assault and batteries, things like that.”

The original agreement did not call for officers to conduct random street operations, investigate day laborers or question the immigration status of anyone.

Police have stopped using computers they obtained from the federal government as part of the program. ICE needs to pick them up.

Even if the department wanted to undertake an expanded role in local immigration enforcement, it does not have the resources to do so.

Carl said it would “crush us, financially.’

Framingham Police do not have the manpower for things like seeking a deportation warrant and going to federal court to testify, said Shastany.

The agreement, in which the federal government authorized two officers to act as immigration officials, unsettled local immigrants.

Shastany said police didn’t use the program “as often as people think.”

Under 287(g), police arrested three immigrants connected to a spate of robberies within the first year of its implementation.

All three had connections to street gangs and were deported to Brazil.

Shastany stressed the department will continue to cooperate with ICE whenever possible. “We’re just not immigration officers,” he said.

The Barnstable County sheriff’s office was also pulling out of the program, according to the Associated Press.

A local ILLEGAL ALIEN HISPANICman told his girlfriend she was “going to die,” as he choked and beat her for about two hours yesterday in a van he stole from the woman’s husband, a prosecutor said in court.

Luis Cervantes, 32, was arrested at 7:31 a.m. after his girlfriend escaped from the van on Edgell Road and ran bare-footed down the street covered in blood and looking for help, prosecutor Felicia Scroggins said in Framingham District Court.

The woman did not appear in court because she was still being treated for her injuries, the prosecutor said.

The woman, who was not named in court, told police that Cervantes picked her up in her husband’s van early Friday morning at a party.

He was upset because she had been drinking and punched her in the face, Scroggins said.

They pulled up to Cervantes’ 258 Edgell Road home, and the woman tried to get out of the van.

“He stopped her and said, ‘Try to get out of this vehicle and I will kill you,’ ” said Scroggins. “For the next one and a half hours he punched her and yelled at her that he was going to kill her.”

At one point, Cervantes began choking the woman, who said she almost blacked out. “While being strangled by this defendant, he told her she was going to die,” said Scroggins. “This ordeal lasted two hours and she said she couldn’t even count the number of times she was punched in the face.”

After two hours, the woman said she scratched Cervantes a couple of times and she jumped out of the van without her shoes and ran for help.

“A man called police and said he saw a woman who was covered in blood, running up the street trying to flag cars down,” said Scroggins. “She had blood and several bruises all over her face and arms. The front of her shirt was covered with blood.”

Police later stopped the van Cervantes was driving and found the woman’s shoes in it. They also discovered that Cervantes had stolen the van from the woman’s husband.

Cervantes was charged with attempted murder, kidnapping by confinement, assault and battery, threatening to commit murder and intimidating a witness.

Scroggins asked Judge Paul Healy Jr. to hold Cervantes without bail pending a hearing to determine if he is a danger to the public.

Cervantes’ lawyer, Bridgett Bradley, did not argue for bail, and Healy ordered Cervantes held at least until Thursday’s hearing.

In a probable cause statement obtained by KGW, a woman claimed she saw Hernandez hit the child.

Lisa Itel told the court she observed the toddler as he was struck by the pickup truck. Hernandez got out of his vehicle and approached the toddler, who was lying in the street, Itel said.

Hernandez “stood there for a while, talked on his cell phone and then got in his car and left the area,” Itel said.

The witness statement contradicted claims by Hernandez that he did not know he’d hit the child.

The toddler was with his family at a store near the intersection of Front and Harrison streets around 4 p.m. Monday when he ran into the street and was hit by a white GMC truck, which drove away from the scene after the impact, according to police reports.

The Mexican anchor baby died at the scene.

The defendant’s license was suspended after the 2006 arrest and then reinstated May 1 of that year. He entered a guilty plea and also completed a year-long diversion program that included alcohol treatment.

Hernandez was being held on a $500,000 bail.
